Banned (Again) by American Idol

As most of you know, 2 weeks ago the music video for my song "American Idol" was taken down by Youtube by Fremantle International.

They took us down because we used clips from the TV show (many of them the same exact clips that hundred of other similar parodies on youtube are using too).

We re-shot the video and removed all their media.

We uploaded the new video and Youtube took it down almost immediately.

This was due to an automatic process that Youtube uses so we went through youtube's dispute process, and youtube put the video back up.

This was yesterday.

This morning youtube took the new video down and they SUSPENDED my youutbe channel all at the request of Fremantle media.

Yep, all the hard work that I put into my youtube channel is gone.

I have used none of their media in this new video. It is straight out parody.

Their objection to my video has nothing to do with copyright infringement. It had to do with the fact that I dared to speak critically about their show.

Why some people should keep their mouths shut

No sooner do I  write a post on critiques, and I get this great story forwarded to me.

Polyclitus, the famous sculptor in ancient Greece, once sculpted two statues at the same time: one in his living room, in public view, and one in his
bedroom, which he worked on privately and kept wrapped in a tarpaulin. When visitors came by, they would comment on the public work, saying,
"The eyes aren't quite right" or "That thigh is too long," and Polyclitus would incorporate their suggestions. All the while, however, he kept
the other statue a secret. Both works were completed at about the same time and were mounted in the city square in Athens. The statue that had
been designed by committee was openly mocked and ridiculed. The statue he'd done by himself was immediately proclaimed a transcendental work
of art. People asked Polyclitus, "How can one statue be so good and the other so bad?" And Polyclitus answered, "Because I did this one (the secret statue) and you did that one."

Dealing with Criticism.

In my lifetime I have been critiqued by the best and the worst.

I have been critiqued by people who had no business giving their opinion and I have received crtiques that where worth gold.

Part of putting yourself up on stage as a performer is that you are leaving yourself open to ridicule as well as praise.

Now that I have started watching American Idol this year. I've noticed a lot of times where Simon is telling someone that they can't sing, and he is right. They can't sing, but that does not mean that they cannot ever sing.

While there are those who are god awful and delusional, there where also plenty of contestants that if I was a judge on the show, I would have said: "You're close, but you need to work on it. Get some professional coaching, get experience performing publicly, and come back in a year".

Even those who are terrible, I would say "Right now you can't sing well at all, so if this is something you are serious about, you need to start working really heard and get some lessons".

We all want a pat on the back and we all need it, but we also need to hear what we are doing wrong from people who have the experience to know it.

I feel very lucky that I have my friend and songwriting partner Kathy at most of my gigs to tell me what was wrong and what was right.

I also feel lucky that early on I got some very good professional critiques/advice from some solid pros in the industry.

Another thing when getting criticism is the source. The most negatives things that where ever said to me, where usually given from someone who was terrible themselves (or at least I beleived they where terrible LOL). In fact there is something to be said for the theory that untalented people are always the quickest and first to tear down people who are talented....but that doesn't mean that they are always wrong with their critique.

it's a slippery slope sometimes wondering when to trust others and when to trust yourself.

I can remember numerous times where Howard Stern would tell a band that asked for a critique that they sucked. The band would be upset, and he would say "Then go out and prove me wrong".

Which is great advice.

Banned By American Idol

I hope you got to see my American Idol video last week.....Because it has been banned!

I wish this was a joke.

Let me tell you what happened.

As you know, my song "American Idol" is critical of the show because it points out the fact that they do not  allow anyone over 29  to compete.

We filmed a funny video that used used clips from American Idol to make it look like my performance of the song was being judged on the show.

We premiered the video on Tuesday 02/14/09

On Friday 02/16/09  we broke over 20 thousand views

On Saturday morning 02/17/09  We  found out that that the video had

been pulled from youtube at the request of Fremantle International (the company that owns the American Idol TV show).

They claimed copyright infringement because we used clips from their show in our video.

We felt that the use of those clips falls under the legal category of "fair use" which allows usage of copyrighted  material for satire and parody.

If you go to youtube you will find thousands of American Idol parodies. A good number of those parodies use clips from the show too.

So why aren't those clips removed from youtube also?

Maybe it's because none of those parodies where being critical of the show.

Maybe it's because my song points out an uncomfortable  fact about the show,  that American Idol doesn't want to talk about and wants to avoid any kind of public discussion about it.

American Idol is an entertaining show, but I personally think it's wrong and terribly "Un-American" for them to bar anyone who has the talent to compete just on the basis of their age.

In my opinion you might as well exclude anyone for race, religion or anything else, because it's the same thing.

Which is why until last year, I never watched the show and encouraged people avoid watching it.

SO WHAT HAPPENS NOW?

I need to speak to some individuals of the Lawerly persuasion.

I could fight this legally, but the money (at least thousands, possibly hundreds of thousands) to hire an attorney is not an option to someone of my means.

But there are other ways I can fight this. And that is what I am looking into now.

You will be interested in this album if you are a fan of:  early rock from the 50's, blues, R&B from the early 60's and great songwriting.

I remember turning on the TV one late night to watch Saturday Night Live. The week before it had been announced that the Sex Pistols would be the musical guests. But the Pistol's must have backed out or something, because instead  the musical guest was this guy that I had never heard of (till then anyways) named Elvis Costello.

At the time music was the domain of bands like Led Zeppelin,  and Van Halen. Long hair and looking like you where the bad ass who got kicked out of school was look that most Rock musicians went for. And I of course was into these bands. So here was this guy who at first glance looked to me more like the school bookworm than a rock star (and back then I was still to musically uneducated to realize that Elvis was riffing on Buddy Holly's look).

Today, most people remember this first US TV appearance by Elvis Costello for the song "Radio Radio". He launched into the performance by playing "Less than Zero", a few bars in he stopped the band, apologized to the audience and played Radio Radio (a scathing attack on the radio industry. In doing this one simple thing, He went against what his record label wanted, and he and was banned by SNL for 12 years.....But what really grabbed me about this guy was his performance of "Watching the Detectives". I couldn't get over how intense and angry this guy came off.

If I thought he looked like a bookworm at first, I quickly changed my mind. Suddenly he looked like a bookworm who would crunch your nuts and then walk off with your woman. he looked like this angry M.F. who wanted to stick his middle finger in the face of every long haired Robert Plant Wannabe in the world.

I was immediately taken by his intensity and went out and got his first album "My Aim is True". It is still to this day one of my favorite albums and a real turning point for me as it signaled the expansion of my musical palate beyond just Hard Rock and Heavy Metal (although I still love both of those genres).

I remember some of my "rocker" friends made fun of me for getting this record. That's because all they had seen was the cover with this bookworm looking guy holding a guitar in a funky pose. They hadn't seen him live. They didn't realize how intense he was. This guy was as angry as me, and I loved him for it.

Looking back now, it's amazing who timeless all these songs sound. There is a strong influence of Motown, R&B, Blues, and 50's Rock'n'Roll. Elvis took all these genres and put new spins on it. He wrote songs with strong hooks and clever, intriguing lyrics.....AND IT WAS ONLY HIS FIRST ALBUM!

Listening to this album with the benefit of hindsight, it's amazing to consider that as awesome a songwriter as he was, he was only going to get BETTER as the years went on.

lines like "I used to be disgusted, but now I try to be amused" from the song "Angels Wanna Wear My Red Shoes", became slogans that people put on bumper stickers and buttons.

Major music stars of the time started covering his songs.

Since then Elvis has stopped being as angry (so have I, come to think of it). But he's never stopped being one of the rock and pop's best songwriters.

Music Worth Buying 01/21/09 Asia & Rush Live DVDss

You might be interested in this album if you are a fan of: Asia, Yes, King Crimson
Tell Me More: Anyone old enough to remember the release of Asia’s eponymous 1982 debut recalls the success of that album, as well as the group’s subsequent sophomore effort, 1983’s “Alpha.”

One of the world’s first true super groups, singer-bassist John Wetton (King Crimson, U.K.), drummer Carl Palmer (Emerson, Lake & Palmer), guitarist Steve Howe (Yes) and keyboardist Geoff Downes (The Buggles, Yes) broke up after only two albums leaving fans of the talented quartet with little more than a few dozen songs to remember the band by.
However, for fans of Asia, the 25th anniversary of Asia was met with a full-blown, extended world tour that displayed the members’ still-dazzling skills intact. Indeed, I was fully impressed with the band’s full-length concert at Vault 350 in Long Beach in September 2006. In addition, the group recorded a new collection of memorable songs, “Phoenix,” that was released in April 2008 and proved to be one of the best rock albums of the year.

Now fans of Asia can pick up “Fantasia: Live In Toyko,” a wonderful DVD title released by Eagle Rock Entertainment that was issued in October 2007 but that I only recently picked up. Filmed in March 2007, the concert DVD features Asia performing 18 songs from those two well-known early ‘80s albums, as well as seminal material the members recorded with their earlier projects.
So in addition to getting top-notch versions of Asia classics such as “Sole Survivor,” “Heat of the Moment” and “Wildest Dreams,” recommended takes on Yes’ “Roundabout,” the Buggles’ “Video Killed the Radio Star” and ELP’s “Fanfare for the Common Man” are performed.
The aforementioned “Sole Survivor” is particularly powerful, with Howe delivering an extended guitar solo that really builds on the original studio recording.  Another highlight is “Don’t Cry,” which showcases Wetton’s emotive tenor and sparse guitar playing, while Howe adds strong textures on mandolin.
Does lightening strike the same place twice? As evidenced by “Fantasia: Live In Tokyo,” it did with Asia.

Tell Me More: Although I didn’t get to see any of the dates on Rush’s Snakes & Arrows tour a few years back, I feel like I had the best seat in the house at one of the concert dates thanks to the release of a recently-released “Snakes & Arrows Live” DVD.

From the set-opening “Limelight” and arresting “Between the Wheels” to the accessible “The Spirit of Radio” and radio favorite “Tom Sawyer,” the Canadian trio is captured perfectly across this impressive 3-disc set.  One of the most ambitious concert DVDs I have ever seen, “Snakes & Arrows Live” was filmed with 21 high definition cameras in 16x9 widescreen format over two nights at the Netherlands’ Ahoy Rotterdam arena. In addition, additional songs not featured during either of those shows were chronicled in Atlanta in July 2008 to complete a winning concert experience for fans of the band.
Extras abound on the DVD, with bloopers bringing the personality of the band more into focus for long-time or new fans of the trio. After watching this notable collection, there is no doubt that few bands possess the sonic firepower of singer-vocalist Geddy Lee, guitarist Alex Lifeson and drummer Neil Peart.

After 35 years of music making, they continue to be the rare band able to fuse progressive and classic rock together with a voice that defies categorization and is simply theirs alone.

Anyone can be KISS

According to Music Connection magazine: Rock group Kiss is rumored to be planning to launch a reality series to recruit 4 new members for KISS. This will be the New Kiss, and would be done in an American Idol style competition.

To be honest, this doesn't surprise me.

I think that Kiss has always gotten a bad rap because of the make up and costumes. But one thing that the band has always understood is a good solid musical hook. Also, original lead guitarist Ace Frehley was a big influence on my own guitar playing. And that is why I have a lot of their music in my ipod.

But does anyone remember when Kiss where the demons of rock? 

Now they've become the Menudo of Rock.

I wonder if I should audition for the part of Ace? 

Itunes store says goodbye to DRM and hello to variable pricing

The Major Labels have wanted variable pricing for years now.

They want to charge more for their "hot" artists.

It looks like they are going to get this now.....BUT prices are going to drop (lower than what Amazon is currently listing in their store) on their not so hot aritsts.

My take: This could backfire on the labels, but will be good for the rest of us.

Their "hot" artist are mostly all youth oriented. Youth have less money and are more prone to illegally download. Raising the price on their music could encourage them to illeagally download it, or not buy it at all.

I on the other hand will be able to purchase the music I want for less (Since I am not interested in Brittany LOL).

I hope that my albums will also go down to the new 69 cents a song mentioned in this article. I will sell more songs if it does.

I actually went through a lot of trouble to look really really grimy for this photo.

I didn't shave for days, I didn't wash my hair, Kathy and I created a goop out of mustard and peanut butter (and some other stuff that I can't remember) and smeared it on my shirt and pants.

What's funny, is that very little of that effort showed up in the photo. I guess I should have worn a plain white T shirt, but I didn't have any plain white T's,  and I used clothes that I didn't mind ruining.

Music Worth Buying 01/05/09 Sean Lennon

Worth Buying: Yes, the whole album.

You might be interested in this album if you are a fan of: Beck, Ethereal Pop, Quirky and or artsy (but not pretentious) singer songwriters......and John Lennon too.

When John Lennon's older son Julian released his first solo album it got good reviews. It was a good album. But everyone in the media seemed to fixate on how much Julian's voice sounded like his fathers. The word eerie was often used.

And in spite of the good reviews he got, It was kind've unfair in a way that they centered on this and not on the fact that he was good songwriter in his own right.

But for Mr. Lennon's younger son Sean, this was not a problem.

When I first heard Sean Lennon's debut album "Into The Sun", my first thought was how much he didn't sound like his father......And yet, in a strange way he did.

With "Into the Sun" Sean Ono Lennon proved that he was very much his father's son, not by sounding like him, but by being as innovative as him.  

Into the Sun is to me one of the most overlooked albums of 2006. There are moments when you can hear traces of his father, especially on a song like "home" with its spacey slide guitar echoing Strawberry Fields. But for the most part, I would have to compare Sean Lennon more to idiosyncratic artists like Beck then to his famous father.

If I where to describe the music on this CD I would call it dreamy ethereal pop with occasional dips into grunge, bossa nova, jazz, and psychedelia. Sean himself is a very good and very expressive musician. He may not have a voice as strong as his father but his vocals are sincere and he makes his vocals work.

If you can listen to this album without preconceived notions of what the son of a Rock icon should sound like and accept it on its own terms, I think you will be richly rewarded with the musical landscapes that Sean Lennon paints for you.

What about the Packaging? The CD comes in a standard jewel case with a nice booklet that features the lyrics and some nice illustrations.

Every Day is New Years Day

"Nothing changes on new years day".........U2

At this time of year we all do, what we call our New Years resolutions.

What strikes me as odd is why we only do this once a year. As if January 1st is the only time we can start new. True, a lot of peoples business start to slow down just before the 1st and a lot of people take advantage of this to re-organize their work space or work flow, etc. But in your personal and professional life why wait till Jan 1st?

I started taking the attitude that that each day is a band new start. If you didn't quite meet your expectations for the day, each day's end is a chance to rethink and each new day a chance to start over.

The moment you start to do this the possibilities become endless.
